This Privacy Policy explains the privacy practices governing the information collected through and its web pages, interactive features, applications, and respective contents, whether accessed via computer, mobile device or other technology (collectively, the “Site”) owned and operated by SXWorks, LLC, a SoundExchange company (“SXWorks,” “we,” “us,” and “our”). Please read this Privacy Policy carefully because when you submit information to or through the Site, you are consenting to SXWorks’ collection, processing and retention of your information as described in this Privacy Policy. Capitalized terms used but not defined herein have the meanings assigned to them in the Terms of Use.

Information You Provide to Us:
When using the Site or registering for an account, we may ask you to provide us with certain information such as your name, e-mail address, company name, and phone number (“Personal Information”). SXWorks may also ask you to provide other information about yourself, such as demographic information. If we combine demographic or other information we collect about you with Personal Information about you, we will treat the combined information as Personal Information. If you do not want your Personal Information collected, please do not submit it.

Information We Collect Automatically:
Usage Information. We collect certain usage information about the Site, such as the number and frequency of visitors to certain parts of the website, browser type, operating system, page served, and preceding page views (“Usage Information”). Usage Information is generally non-identifying, but if SXWorks associates it with you as a specific and identifiable person, SXWorks treats it as Personal Information. SXWorks may provide aggregate statistics about Usage Information or demographic information with third-parties, but this information will not include Personal Information.

Device Information. In the course of collecting Usage Information, SXWorks also may automatically collect your IP address or other unique identifier (“Device Identifier”) for the computer, mobile device, technology or other device (collectively, “Device”) you use to access the Site. A Device Identifier is a number that is automatically assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier. When you visit the Site, we may view your Device Identifier. We use this information to improve your experience on the Site, to enhance our Site, and to protect the Site.

Cookies. The technologies used on the Site to collect Usage Information, including Device Identifiers, may include, without limitation, cookies. Cookies are data files placed on a Device when it is used to visit the Site. SXWorks may place cookies or similar files on your Device for security purposes, to tell us whether you have visited the Site before, if you are a new visitor or to otherwise facilitate site navigation, and to personalize your experience while visiting our Site. We may also use your information to:

• respond to requests for customer support or general inquiries;
• to improve the SXWorks Site;
• to personalize and support your experience on the Site;
• to contact you regarding products and services offered by the SXWorks Parties that may be of interest to you;
• to send you communications including newsletters and other notifications regarding changes to our Site, updates, and administrative messages;
• to verify your identity, detect or prevent fraud, or security alerts;
• for any other purpose for which the information was collected;

We will only use the information you provide to us in a manner that is consistent with this Privacy Policy or where we have otherwise obtained your consent.

Political Advocacy. From time to time, SXWorks participates in political advocacy regarding important intellectual property ownership and performance rights. We may send you e-mails to seek your involvement and assistance in campaign activities, such as signing petitions or surveys, or sending emails including your information to political representatives.


SXWorks Parties. We may share your information (including your Personal Information) with the SXWorks Parties for their own marketing or advertising purposes.

Service Providers. We may enter into relationships with third parties who: (a) provide vendor services to us (e.g. data management, billing, storage services, and IT services) or (b) perform functions on our behalf, such as companies or individuals that host or operate our Site, analyze data, or provide customer service. In any of these circumstances, we disclose Personal Information only to the extent it is necessary, and we further require that the third party maintain the confidentiality of your Personal Information. SXWorks does not otherwise share, nor does it sell, trade or rent, your Personal Information to third parties.

By using the Site, you consent to our use of Invisible reCAPTCHA. Use of Invisible reCAPTCHA is subject to Google’s Privacy Policy and Terms of Service.

E.U. residents: Google will truncate your IP address within member states of the European Union or in other states which are party to the agreement on the European Economic Area and your IP address, is therefore anonymized. Only in exceptional circumstances is a full IP address transmitted to a Google server in the United States and truncated there. On behalf of SXWorks, Google will use this information to evaluate your use of this Site. The IP address provided by reCAPTCHA from your browser shall not be merged with any other data from Google. This data collection is subject to Google’s E.U. Privacy Policy and Terms of Service.

Business Transfers. We may share your information, including Personal Information, with our parent company, SoundExchange, Inc. (or its subsidiaries and affiliates) for internal reasons, primarily for business and operational purposes. We may share or transfer your information, including your Personal Information in connection with a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control by SXWorks or any affiliated company (in each case, whether in whole or in part).

Legal Disclosure. We will share your Personal Information, Usage Information, or Device Identifier if we are compelled to do so by law or by a governmental agency, court or other entity (e.g. to respond to subpoenas, court orders or legal process); if we believe your actions violate a law, regulation, this Privacy Policy or the SXWorks Terms, or if you threaten the rights, property or safety of us, our Site, any other users or third party; or if, in our sole discretion, we believe disclosure is necessary to investigate or resolve possible problems or inquiries, to protect our assets, to defend our interests, our users, the public or to comply with our legal and regulatory obligations.


You may always direct us not to use your Personal Information to provide you with updates, offers, or not to send you newsletters, emails or other communications by:

If you wish to verify, correct, or update any of your Personal Information collected through the Site, you may update your information through your account or contact us at the email included above. In accordance with our routine record keeping, we may delete certain records that contain Personal Information that you have submitted through the Site. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups or other technology-related reasons.


We do not share your Personal Information with third parties for their marketing purposes without your consent.


Although SXWorks uses reasonable efforts to safeguard your Personal Information, transmissions made by means of the Internet cannot be made absolutely secure. All third parties that provide services for us are obligated to protect your Personal Information in accordance with SXWorks’ policies, except if we inform you otherwise at the time of collection. We are not responsible, and will have no liability for, disclosure of Personal Information due to errors in transmission or the unauthorized acts of third parties.


The Site may provide links to other websites that we do not own or operate. To the extent that any linked websites are not part of the Site, we do not control, recommend or endorse and are not responsible for these websites or their content, products, services, or privacy policies or practices. These other websites may send their own cookies to your Device, they may independently collect data or solicit Personal Information and may or may not have their own privacy notices or policies. You should also independently assess the authenticity of any website which appears or claims that it is our Site (including those linked to through an email or social networking page).


SXWorks does not knowingly collect any Personal Information from anyone under the age of 13. If a child under 13 submits Personal Information to SXWorks and we learn that that Personal Information is the information of a child under 13, we will attempt to delete the information as soon as possible.


The Site is operated in the United States. Given that we are an international business, our use of your information necessarily involves the transmission of data on an international basis. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the Site or providing us with any information, you consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be comprehensive as or equivalent to, those in the country where you reside and/or are a citizen.

Such changes and/or modifications shall be posted on the SXWorks website and shall be effective immediately upon the posting thereof.
